3. Legal Basis for Processing
We process your personal data based on: (a) performance of a contract for campaign execution services; (b) your explicit consent for marketing communications; (c) our legitimate interest in optimizing advertising campaigns and service delivery; and (d) compliance with legal obligations under EU Regulation 2016/679 (GDPR).
4. Data Retention
Campaign performance data and associated personal identifiers are retained for the duration of the active service contract plus 24 months. Financial records are retained for 5 years in compliance with French accounting regulations. Analytics data is anonymized after 12 months.
5. Data Sharing
We share data with advertising platform partners (Google, Meta, TikTok, LinkedIn) solely for the purpose of executing your campaigns. All partners are bound by Data Processing Agreements. We do not sell personal data to third parties. Data may be shared with payment processors for transaction handling.
6. Your Rights
Under GDPR, you have the right to: access your personal data, rectify inaccurate data, erase your data, restrict processing, data portability, and object to processing. You may exercise these rights by contacting [email protected]. You also have the right to lodge a complaint with the CNIL (Commission Nationale de l'Informatique et des Libertés).
7. International Transfers
Campaign data may be transferred to advertising platforms hosted outside the European Economic Area. Such transfers are protected by Standard Contractual Clauses (SCCs) approved by the European Commission. We ensure equivalent data protection standards for all international transfers.
Terms of Service

1. Service Scope
DigitalMarketWorks provides end-to-end multi-channel advertising campaign execution, automated media buying, and paid funnel optimization services. All services are delivered as described in the service agreement and associated scope documents provided at contract signing.
2. Campaign Performance
While we deploy industry-best practices and data-driven optimization, we do not guarantee specific advertising outcomes including but not limited to: click-through rates, conversion rates, ROAS figures, or lead volume. Campaign performance depends on market conditions, competitor activity, and platform algorithm changes.
3. Payment Terms
Service fees are invoiced monthly in advance. Ad spend budgets are managed via client-provided platform access and are invoiced separately. Late payments incur a 1.5% monthly interest charge. All prices are listed in EUR and exclude applicable VAT.
4. Client Responsibilities
The client is responsible for: providing timely access to advertising platforms, approving creative assets within agreed timelines, maintaining sufficient ad spend budgets, and responding to campaign optimization recommendations within 48 hours.
5. Intellectual Property
All creative assets, ad copy, and campaign strategies produced by DigitalMarketWorks remain the property of DigitalMarketWorks until full payment is received. Upon payment, the client receives a non-exclusive license to use deliverables for the contracted campaign purposes.
6. Limitation of Liability
DigitalMarketWorks' total liability shall not exceed the total service fees paid in the 12 months preceding the claim. We are not liable for indirect damages, lost profits, or business interruption arising from campaign performance variations.
7. Termination
Either party may terminate with 30 days written notice. Early termination by the client requires payment for all work completed and committed ad spend obligations. DigitalMarketWorks may terminate immediately upon material breach or non-payment.

Refund & Reimbursement Policy

1. Service Fee Refunds
Service fees for campaign setup and management are non-refundable once work has commenced. If DigitalMarketWorks fails to deliver the agreed scope of work, a pro-rated refund will be calculated based on completed vs. remaining deliverables within 30 days of termination.
2. Ad Spend Refunds
Ad spend budgets managed on your behalf are paid directly to advertising platforms. Refunds for unused ad spend must be requested through the respective platform (Google, Meta, TikTok). DigitalMarketWorks will assist with refund requests but cannot guarantee platform approval.
3. Cancellation Window
Campaign services may be cancelled within 72 hours of contract signing for a full refund of setup fees, provided no work has been initiated. After this window, the standard termination terms apply as outlined in Section 7 of the Terms of Service.
4. Campaign Performance Disputes
If campaign performance falls below mutually agreed KPI thresholds defined in the service agreement, DigitalMarketWorks will provide a remediation plan within 5 business days. If remediation fails to improve performance within 30 days, the client may request a partial refund of management fees for the affected period.
5. Refund Process
Refund requests must be submitted in writing to [email protected] with the subject line "Refund Request – [Contract Reference]". All refund requests are reviewed within 5 business days. Approved refunds are processed to the original payment method within 14 business days.
6. Dispute Resolution
Any disputes regarding refunds shall first be addressed through direct negotiation between the parties. If unresolved within 30 days, disputes will be submitted to mediation in Meaux, France. The governing law is the law of the French Republic.
